He started playing the 40k rebuy friday night then after 15 minutes of play sent me a message saying he had to run out and if I wanted a backer to play since I wasnt in it. So of course I played (who wouldnt with nothing to lose) and finished 57th for $160. What do you guys think? Is this cheating or a violation of the terms of usage of the site?

Seems kind of sleazy to me and gives me one more reason to look at online playing suspiciously.

For your further information these guys aren't roommates. One lives in California and the other lives in New York.

That's definitely sketchy behaviour. Not as bad as the "group" hoax. I've heard people actually brag how they sit at a table (online) with 4 or 5 friends and use a seperate chat (like Instant Messenger) to discuss their cards. Often times one "partner" will raise with junk knowing his buddy has a monster just to create bigger pots. Hard to catch.
