Looks OK to me. BB probably has a 9, but maybe not.
Edit: On second thought, this is a small pot, so no need to be shy about folding.

am i folding because the pots so small, and there is nothing he would check raise with that i beat? if the pot was bigger do i call down?

its got to be huge and you have to have a good read.
What do you suspect BB check/raises the turn with that you beat?

This depends on how many times you think you can beat him when putting him on a hand he is c/r'ing or, does he bluff with a c/r? If so how many times does he have the goods compared to the c/r bluff?
