Was listening to the radio today and heard the story of Dylan Pardo, a 14 year old rape victim. The rapist, a 16 year old at the time, gave her a date-rape drug which rendered her unconscious and then raped her. Under California law, if the victim is unconscious, it's not considered rape. What the hell? Because of this "loophole" in their law, despite the fact HE CONFESSED to this rape and one other rape on a 12year old girl, he is free. No jail time. He was ordered to pay her restitution of $10/month for 12 months. Not only that, his record is clean when he turns 18 as if it never happened.She took her fight to the California legislature to get a bill passed that would change the law to better clarify rape and would also close the loophole. The Legislative committee that held hearings on the bill, killed the bill stating there were already laws in place for this situation. IF that were the case, this animal would be locked up!I found this story that has comments from victim, victim's mother and sister, and various other comments from other posters. Other than stories stating she was appearing on Hannity to garner support for the failed Bill, there wasn't much other information I could find. http://www.bakersfie...ws/read/2/29665One of the comments posted on the site stated some issues about the Bill that was killed and that the way it was written it would have caused more harm than good. If the person comments are correct, then a Bill needs to be written to address this "loophole" and close it!I'm not naive enough to think this is only happening in California or that other situations like this one or other situations where "loopholes" exist. Other than to continue to pressure elected officials to write laws that make sense or try to elect people who will write laws that make sense, I don't know the answer.Anyone else have comments on this?
