Yesterday, the New York State Court of Appeals (our state supreme court) upheld a 2001 law that effectively allowed for the expansion of gambling in the state, primarily in the form of more lotteries, more horse tracks, and more indian casinos. Legal beagles are calling this the most sweeping state court decision on gambling in decades.The really interesting part is this: In responding to opponents of gambling who believe that the NY State Constitution outlaws it, the Court cited a U.S. Supreme Court ruling and stated that, "if the state allows any form of gambling including lotteries and bingo it has lost the power to ban gambling anywhere in the state, regardless of what the state's constitution may say". Lost the power??? Wow. This is going to have huge, long term, far reaching, positive ramifications for private card rooms and online gambling, imo.Thought I would share.

Not really. The state does lose the power to "ban gambling" but not to regulate it, such as allowing only certain forms, or certain locations. It still has the power to ban certain types of gambling.It will be interesting to follow the evolution, though.

If anyone lives in Texas you should visit and join Texansforpoker at www.texansforpoker.net the TABC is starting to shut down charity poker tournaments as they hear about them because it is illegal in their mind.
